Terms of Service

1. Acceptance of Terms
By creating an account or using Myfolio (“the Service”), operated by Myfolio Studio (“we”, “us”, “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including free and paid subscribers.
2. Description of Service
Myfolio is a private portfolio platform that allows photographers and visual creatives to create password-protected or token-gated galleries to share with clients and collaborators. The Service includes gallery creation, image hosting, viewer access management, and usage analytics.
3. Account Registration
You must be at least 18 years old to create an account. You are responsible for maintaining the security of your login credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date.
We reserve the right to suspend or terminate accounts that violate these terms, contain false information, or are used for unauthorized purposes.
4. Subscriptions and Billing
Myfolio offers a free tier and a Pro subscription. Pro is available on a monthly or annual basis:
- Myfolio Pro — Monthly: $12.00 USD per month, billed monthly. Auto-renews each month until cancelled.
- Myfolio Pro — Annual: $99.00 USD per year ($8.25/month), billed annually. Auto-renews each year until cancelled.
Subscriptions purchased through the iOS App Store are billed at the prices displayed in the App Store and are subject to Apple's billing terms. Web subscriptions are processed by Stripe.
All fees are charged in USD and are non-refundable except as required by applicable law or as stated in our refund policy below. We reserve the right to change pricing with 30 days' notice to existing subscribers.
5. Auto-Renewal and Cancellation
Your subscription automatically renews at the end of each billing period unless cancelled before the renewal date. You can cancel at any time from your dashboard or, for App Store subscriptions, from your Apple ID subscription settings.
Cancellation takes effect at the end of the current billing period. You retain access to Pro features until that date. We do not prorate refunds for unused time unless required by law.
6. Refunds
Web subscriptions: if you are unsatisfied within the first 7 days of a new subscription, contact us at support@myfolio.studio and we will issue a full refund at our discretion.
App Store subscriptions are subject to Apple's refund policy. We cannot issue refunds for purchases made through Apple.
7. Your Content
You retain full ownership of all photos, images, and other content you upload to the Service (“Your Content”). By uploading content, you grant us a limited, non-exclusive, royalty-free license to store, process, and serve Your Content solely for the purpose of providing the Service to you.
We will never use Your Content for advertising, sell it to third parties, or share it with anyone other than the viewers you explicitly authorize.
8. Acceptable Use
You agree not to use the Service to:
- — Upload content that is illegal, defamatory, or infringes on the intellectual property rights of others
- — Upload non-consensual intimate imagery or content involving minors
- — Attempt to gain unauthorized access to any part of the Service or another user's account
- — Use the Service for spam, phishing, or any fraudulent purpose
- — Reverse engineer, scrape, or otherwise misuse the Service or its infrastructure
- — Violate any applicable local, national, or international law or regulation
We reserve the right to remove content and suspend accounts that violate these rules, without notice.
9. Free Plan Limits
Free accounts are limited to 5 galleries, 50 images, and 5 viewer links. If your account downgrades from Pro to Free (for example, following a subscription expiry), content that exceeds these limits remains stored but becomes inaccessible to viewers until you upgrade. We do not delete content due to plan changes.
10. Account Deletion
You may delete your account at any time from your profile settings. Upon initiating deletion, your account and content are deactivated immediately. Your data is permanently purged from our systems within 30 days of the deletion request.
If you change your mind, you may contact us at support@myfolio.studio within 30 days to recover your account. After 30 days, recovery is not possible.
11. Intellectual Property
All elements of the Service not constituting Your Content — including the Myfolio name, logo, interface, and underlying software — are owned by Myfolio Studio and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.
12. Disclaimers and Limitation of Liability
The Service is provided “as is” without warranties of any kind, express or implied. We do not guarantee uninterrupted availability and are not liable for any loss of data or business resulting from downtime or technical issues.
To the maximum extent permitted by law, our total liability to you for any claims arising from use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
13. Governing Law
These terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Los Angeles County, California.
14. Changes to These Terms
We may update these terms from time to time. We will notify you of material changes via email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated terms.
